This privacy policy statement refers to data collected through Summit Tractors website (www.summittractors.com) and the Mobile Application. Summit Tractors commits to respect and protect customer´s personal data and sensitive data. All personal data collected under this agreement are collected only to the purpose of fulfilling the contractual services. “You,” “I” and “Customer” all refer to you, the user of the website or Mobile Application.

1. Access to and Use of Data. Customer may also authorize or restrict Dealer and/or 3rd party access at any time. Customer may, two times per calendar year for free, request that Summit Tractors remove access to and use of Data to specific Dealers and/or 3rd party via the Web Functions. Summit Tractors will effectuate such removal within thirty (30) days of Customer’s valid request. Any such restricted Dealer and/or 3rd party may continue to have access to Data collected by the System prior to Summit Tractors' removal of the Dealers and/or 3rd party';s access. Customers may authorize dealers and/or 3rd party to access and use Customer`s Data. Summit Tractors may provide on behalf of the customer Dealers and/or 3rd party information and data for the purpose of servicing Customer’s equipment including machine diagnostics, remote servicing (i.e. but not exclusively to provide update, repairs, assistance) and machine component software updates.

2. Data storage and retention policy. Customer data (any data entered in by Customer referred to collectively as “Data”) is stored on Summit Tractors Servers based in the US. Unless and until Customer requests removal of Summit Tractors ’s access to and use of Data, Summit Tractors will store the Data, provided such data storage is following all applicable federal, state, provincial and local laws and regulations. Summit Tractors will have the right, but not the obligation, to store the Data indefinitely, or to delete the Data at any time upon expiration of the above-stated retention periods provided such data storage is in compliance with all applicable federal, state, provincial, and local laws and regulations. Customer acknowledges and agrees that messaging and position Data deleted from the Server(s) cannot be retrieved or re-created.

3. Permitted Data Disclosure. Summit Tractors may disclose Data to outside parties when we have a good faith belief that disclosure is reasonably necessary to (a) protect the safety of any person from death or serious bodily injury; (b) prevent fraud or abuse against us or our users; (c) to protect our property rights; or (d) defend Summit Tractors and its affiliates or personnel from any legal proceedings arising out of Data Summit Tractors may post anonymized and/or aggregated information about our users without any restrictions.

4. Website Log in and Profile Data. Upon request and within 30 days, Summit Tractors will grant individuals reasonable access to personal information they entered into the System and that it holds about them. In addition, Summit Tractors will take reasonable steps to permit individuals to correct, amend, or delete information that is demonstrated to be inaccurate or incomplete.

5. Persons Under the Age of 18. Our Website is not intended for persons under 18 years of age. No one under age 18 may provide any personal information to or on the Website. We do not knowingly collect personal information from persons under 18. If you are under 18, do not use or provide any information on this Website or Mobile Application, or through any of their features, register on the Website or Mobile Application, make any purchases through the Website or Mobile Application, use any of the interactive or public comment features of this Website or Mobile Application, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or username you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. 6. Privacy Rights in California. Non-Discrimination Rights. Customer has the right not to be discriminated against for exercising their rights under the CCPA. Unless permitted by the CCPA, Summit Tractors will not: (1) deny you goods or services; (2) charge you different prices or rates for goods or services; (3) provide you a different level of quality of goods or services; or (4) suggest that you may receive a different price or rate for goods or services, or a different level of quality of goods and services. This does not prevent Summit Tractors from offering you financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels.

7. Transfer of Information in United States of America. Our site is operated in the United States and intended for users located in the United States. If you are located outside of the United States, please be aware that information we collect, including Personal Information, will be transferred to, processed, stored and used in the United States. The data protection laws in the United States may differ from, and may be less protective or your Personal Information, than those of the country, or aggregation of countries subject to common regulation, in which you reside or are located, and your Personal Information may be shared with third parties for direct marketing purposes and may be subject to access requests from governments, courts, or law enforcement in the United States according to laws of the United States. By using our site or providing us with any information, you consent to the transfer to, and processing, usage, sharing and storage of your information, including Personal Information, in the United States as set forth in this Privacy Policy.

9. Summit Website and Mobile Application Terms. Your visit to the Website or Mobile Application and any dispute over privacy is subject to this Policy and our Summit Website/Mobile Application Terms, including limitations on damages, resolution of disputes, and application of the governing law.
